9Ja Odds — Terms of Use

These Terms of Use (the "Terms") constitute a binding legal agreement between you ("you", "your", or "User") and 9Ja Odds (referred to in these Terms as "9Ja Odds", "we", "us", or "our"), the operator of the website located at https://9-ja.com, its mobile application, and any associated services (collectively, the "Service"). BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICE.

1. Eligibility

By accessing or using the Service you represent and warrant that: (a) you are at least eighteen (18) years of age; (b) you have the full legal capacity to enter into a binding contract under the laws of the jurisdiction in which you reside; (c) your use of the Service is not prohibited by the laws of the jurisdiction in which you reside; and (d) you will use the Service only for lawful purposes and in strict accordance with these Terms.

Access by any person under the age of eighteen (18) is strictly prohibited. We reserve the right, at our sole discretion, to refuse access to the Service to any person who, in our reasonable opinion, fails to meet these eligibility requirements.

2. Nature of the Service — important disclosures

The Service is an educational and informational tool that provides sports-related calculators, mathematical analysis, statistical models, aggregated market data, and content aggregated from publicly available third-party sources. The Service is not, and shall not be construed as:

a bookmaker, sportsbook, betting exchange, or gambling operator;
a licensed gambling establishment or gambling intermediary;
a financial-services provider, broker, dealer, or investment adviser;

9Ja Odds does not accept, place, facilitate, broker, mediate, or otherwise process bets or wagers of any kind. We do not handle, hold, or transmit funds in connection with gambling activity. We do not participate in affiliate, referral, or revenue-sharing arrangements with bookmakers, sportsbooks, or gambling operators.

3. No advice; user responsibility

Information made available through the Service — including but not limited to odds, probabilities, expected-value calculations, Kelly-criterion outputs, statistical projections, market averages, tips aggregated from third parties, and news headlines — is provided for general informational and educational purposes only. Nothing on the Service constitutes legal, financial, investment, tax, gambling, or professional advice, and no fiduciary, advisory, or other relationship is created between 9Ja Odds and you by reason of your use of the Service.

You are solely and exclusively responsible for any and all decisions you make, actions you take, or refrain from taking, in reliance on information obtained from or through the Service. Before acting on any such information, you should independently verify it and, where appropriate, consult a qualified professional.

4. Licence to use the Service

Subject to your continued compliance with these Terms, 9Ja Odds grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your personal, non-commercial use only. All rights not expressly granted to you are reserved by 9Ja Odds and its licensors.

5. Prohibited uses

You agree that you shall not, and shall not permit, encourage, or assist any third party to:

use the Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms;
use the Service in any jurisdiction in which such use is prohibited or restricted by applicable law;
copy, reproduce, distribute, republish, download, display, post, transmit, sell, licence, modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works of any portion of the Service except as expressly permitted by these Terms;
use any robot, spider, scraper, or other automated means to access the Service for any purpose without our prior written consent;
attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service;
impose an unreasonable or disproportionately large load on our infrastructure;
upload, post, or transmit through the Service any material containing software viruses, worms, trojan horses, or other malicious code;
impersonate any person or entity, or misrepresent your affiliation with any person or entity;
use the Service to harass, abuse, threaten, defame, or otherwise harm any other person;
use the Service to engage in, promote, or facilitate any form of gambling that is unlawful in your jurisdiction.

6. Intellectual property

The Service, including all of its content, features, design, code, calculators, mathematical models, layout, text, graphics, logos, icons, and the selection, coordination and arrangement of all of the foregoing (collectively, the "Content"), and all intellectual-property rights therein, are and shall remain the exclusive property of 9Ja Odds and its licensors. The trade marks, service marks, logos, and trade dress displayed on the Service are the trade marks or registered trade marks of 9Ja Odds and others. Nothing in these Terms shall be construed as granting, by implication, estoppel or otherwise, any licence or right to use any such trade mark without the prior written consent of its owner.

Headlines, excerpts, and other content displayed in the Articles, Predictions, and News sections are aggregated from publicly available third-party sources and remain the exclusive property of their respective publishers. 9Ja Odds claims no ownership of such third-party content.

7. Third-party content and links

The Service may contain links to, or display information aggregated from, third-party websites, services, or feeds that are not owned or controlled by 9Ja Odds. We do not endorse and are not responsible for the content, privacy policies, accuracy, completeness, lawfulness, reliability, or availability of any such third party. You acknowledge that 9Ja Odds is not, and shall not be, liable for any damages, losses, or other harm caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content. Your interactions with third-party sites and services are governed by the terms and policies of those third parties.

8. DISCLAIMER OF WARRANTIES

THE SERVICE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 9JA ODDS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, 9JA ODDS DOES NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) THE INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, OR CURRENT; (c) ANY DEFECTS WILL BE CORRECTED; OR (d) THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 9JA ODDS, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUES, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, GAMBLING LOSSES, BETTING LOSSES, OR ANY OTHER FINANCIAL LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY CONTENT, EVEN IF 9JA ODDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, THE AGGREGATE LIABILITY OF 9JA ODDS TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED ONE HUNDRED NIGERIAN NAIRA (₦100.00).

You expressly acknowledge that the foregoing limitations of liability are an essential part of the agreement between you and 9Ja Odds, and that the Service would not be provided on an economically reasonable basis without them. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in such jurisdictions, the foregoing exclusions and limitations shall apply to the maximum extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless 9Ja Odds, its operators, owners, employees, agents, suppliers, and licensors from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and disbursements) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual-property right or privacy right; or (d) your violation of any applicable law. We reserve the right to assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defence at your own expense.

11. Modification and termination of the Service

We reserve the right, at our sole discretion and without notice, to modify, suspend, discontinue, or terminate the Service or any portion thereof, at any time and for any reason or no reason. We will have no liability to you or any third party for any such modification, suspension, discontinuance, or termination.

We reserve the right to refuse access to the Service, in whole or in part, to any person at any time and for any lawful reason, including without limitation suspected violation of these Terms.

12. Changes to these Terms

We may amend these Terms from time to time. The "Last updated" date at the top of these Terms will indicate when they were last revised. Material changes will take effect upon posting. Your continued use of the Service after any such change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must immediately cease all use of the Service.

13. Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with these Terms or your use of the Service, shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws principles. You irrevocably agree that the courts of the Federal Republic of Nigeria shall have exclusive jurisdiction to settle any such dispute, and you irrevocably submit to the jurisdiction of those courts.

14. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by applicable law.

15. No waiver

No failure or delay by 9Ja Odds in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise of any right, power, or privilege. Any waiver of any provision of these Terms shall be effective only if made in writing and signed by an authorised representative of 9Ja Odds.

16. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. 9Ja Odds may freely assign, transfer, or delegate any of its rights or obligations under these Terms at any time and without notice.

17. Force majeure

9Ja Odds shall not be liable for any failure or delay in performance under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labour disputes, internet outages, telecommunications failures, infrastructure failures, or technological attacks.

18. Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, Disclaimer, and Responsible Gambling Statement, constitute the entire agreement between you and 9Ja Odds with respect to your access to and use of the Service, and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.
